County Government and plot owners in a row

A legal tussle has
emerged in Nanyuki between Laikipia County Government and plot owners in
Muthaiga estate.

The tussle followed
declaration by the county government that the houses were sold unprocedurally
to the present owners. Plot owners, Francis Ndegwa,  Stephen Gakuu, Esther Wanja and Peter Mukora moved
to Nanyuki court  and obtained orders
restraining the  county government from  taking over their properties.

 Local Principal Magistrate Ben Mararo issued
the orders restraining Governor Ndiritu Muriithi led county government from
evicting the applicants from their houses sitting on a parcel of land the
devolved government is claiming ownership.

 The order by the court reads” the applicants
and the defendant to desist from interfering with the parcels of land and
houses listed as Nanyuki Block 6/186, UNS Residential Plots numbers
“C” and “D” and UNS Residential Plot number “F”
situated behind the Governor’s offices until the matter is heard and
determined.

“…the
defendant/ applicant, his agents, employees, servants or anyone claiming
through him be and are hereby restrained by a temporary injunction from
selling, transferring, charging, developing, wasting,

damaging, evicting
tenants or howsoever interfering in any way with those parcels of land pending
the hearing and determination of this application.”

 The court ordered the matter to be heard on
August 18.
