A Murang’a court has nullified two nomination positions at the local county assembly after UDA supporters lodged a protest.
The court declared the nomination of MCAs Priscilla Njeri and Njiri Julian in the special seats in the gender top up category list as null and void.
In the judgment by Senior Resident Magistrate Ms Susan Mwangi directed the IEBC to re-allocate the gender to up list to the next females in Murang’a county registered voters, in the list the former MCAs were here in.
“ Since the party lists submitted to the electoral body are not required to be amended during the parliamentary term, I certify the re-allocation of the gender top up to the next female,” said the magistrate in her judgement.
During the hearing of the electoral dispute, it emerged that in Murang’a county assembly some of the nominated members voted in Jomvu and Kiambaa constituencies in Mombasa and Kiambu counties respectively.
The petitioners were Joseph Munyao, ,Mwangi Risper Nyambura, Jane Wanjiku Macharia, Kamau Rose Muthoni and Kioko Angela Mueni who were against the 12 nominated MCAs.
The petitioners told the court that they were proposed and nominated by the UDA party under the marginalized category of persons living with disabilities, and ethnicity and gender top up respectively .
The affidavits read, “Priscilla Njeri and Njiri Julian did not meet the qualification for nomination under the Murang’a party list since they were not registered voters in the county.
Four others were picked from Kiharu constituency, hence there was no fair representation in Kangema and Gatanga constituencies.”
There has been bad blood among the Murang’a leaders with MPs Peter Kihungi( Kangema) and Edward Muriu( Gatanga) calling for fairness in the distribution of nomination positions.
