Senate suffered a blow
after High Court restrained the police from arresting Murang’a Governor Mwangi
wa Iria for allegedly defying summons to appear before its public investment
committee.
High Court in Embu
restrained the law enforcers from arresting the Governor after his application
was allowed.
This week the senate
had requested Inspector General of Police Hillary Mutyambai to arrested the
governor and produce him before the committee for interrogation on financial
spending.
In the application the
Governor and Murang’a county government are listed as the applicants, while senate speaker Kenneth Lusaka and senate the
respondents.
Mutyambai is listed
the interested party alongside the 47 county governments.
Justice L.M Njuguna ordered
the matter to be mentioned on September 9 through interparties hearing, as
suspending the decision of the senate.
The matter will be
placed before Justice Mshila.
The court order was
issued a day after Council of Governors chaired by Wycliff Oparanya rubbished conduct
of the senate for seeking the arrest of Iria.
Iria is the vice
chairman to the council who indicated
that he failed to attend the senate meeting after The Senate Speaker banned
session due to the outbreak of Covid 19.
The governor had requested for a virtual
session in efforts to prevent himself from the disease. Senate
Clerk Jeremiah Nyegenye had written to
police seeking the arrest of the governor.
